Official Giveaway Rules

  1. Eligibility: Millennielle’s ‘12 Days of Giveaways’ Series (the “Sweepstakes”) is open to U.S.-based readers  who are at least eighteen (18) years of age. Employees, independent contractors, interns, officers, directors, and agents of Sponsor, other companies associated with the Sweepstakes, as well as the immediate family members (spouse, parents, siblings, and children, and their respective spouses) and household members of any of the foregoing are not eligible to enter. NO PURCHASE NECESSARY TO ENTER OR WIN.  This Sweepstakes is not open to residents of Rhode Island, or any other state which would require registration or the posting of bond of any prize offered in this Sweepstakes.  Any entry by a person in such prohibited jurisdictions shall be treated as void.
  2. Sponsor: The Sweepstakes is sponsored by Millennielle, LLC (“Sponsor”).
  3. Agreement to Official Rules: By entering the Sweepstakes, you indicate your full and unconditional agreement to, and acceptance of, (a) these Official Rules and (b) Sponsor’s decisions, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
  4. Entry Period: The Sweepstakes will run from Friday December 13, 2017 at 12:00am ET until Tuesday December 24, 2017 at 11:55PM ET (unless extended or earlier terminated by Sponsor in its sole discretion), with one entry period during this time (one drawing per day for each entry period). Entries submitted before or after the respective Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Sweepstakes.
  5. How to Enter: To enter, go to www.millennielle.com and click on “12 Days of Giveaways” page for daily entry instructions.  There is a limit of one (1) entry per person/email address; you will only be entered into and eligible to win the Sweepstakes in one Entry Period. Entries in excess of this limit will not be acknowledged. The use of an agency or any automated system to enter is strictly prohibited and Sponsor reserves the right to disqualify any entries received through such methods, as determined by Sponsor, in its sole discretion.
  6. Drawing: At the closing of each Entry Period (each, a “Drawing Time”), Sponsor will select one (1) potential winner.  The odds of being selected depend on the number of entries received. Winners are selected using a random generator {https://www.rafflecopter.org}.
  7. Notification and Requirements of Potential Winners: Each potential winner will be contacted by email within 24 hours that their entry is drawn. If a potential winner does not respond within forty-eight (48) hours after the notice is sent, the Sponsor will select an alternate potential winner in his/her place at random from all remaining entries received. Only three (3) alternate potential winners will be contacted.
  8. Prize(s): For each Entry Period, one (1) winner will receive one (1) item from the ‘12 Days of Damsel’ list (as selected by Sponsor, subject to availability), each with an approximate retail value listed within the post. Winner is responsible for paying any applicable taxes and any and all other costs and expenses not listed. Sponsor will mail the Prize to Winner at such mailing address provided by Winner. The Prize may be subject to additional terms and conditions. A Prize may not be transferred and must be accepted as awarded. You may not request cash or a substitute prize.
  9. General Conditions: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize(s) at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited.
  10. Release and Limitations of Liability: By participating in the Sweepstakes, you agree to release and hold harmless Sponsor, and their parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any prize. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
  11. Privacy and Publicity: Information collected from entrants is subject to Millennielle privacy policy.
  12. Third Party Platforms: If this Sweepstakes is hosted, administered, or operated on a third party platform, including without limitation a social media platform (e.g. Facebook or Twitter) (“Third Party Platform”), then by participating in this Sweepstakes, entrants hereby release and agree to hold harmless such Third Party Platform from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prizes or participation in any prize-related activities. Unless otherwise stated to the contrary in these Official Rules, this Sweepstakes is not sponsored, endorsed or administered by, or associated with, any Third Party Platform.
  13. LIMITATION OF LIABILITY.  To the maximum extent permitted by law, Sponsor, its affiliated entities, and its shareholders, officers, , directors, members, managers, employees, agents, attorneys, successors and assigns (the “Released Parties”) shall not be held liable or responsible for, and each Entrant (including Prize Winners) hereby releases the Released Parties from, any claims arising from or in any way relating to the Sweepstakes, including, but not limited to, the following: (i) the subject matter of the Sweepstakes; (ii) any inability to submit a Sweepstakes entry; (iii) any defects or deficiencies in a Sweepstakes entry; (iii) the content or context of any Sweepstakes entry; (iv) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (v) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (vi) unauthorized human intervention in any part of the entry process or the Sweepstakes; (vii) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; (viii) any injury or damage to persons or property, including but not limited to entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes;  (ix) use or redemption of any prize; (x) the judging process, including the outcome of the Sweepstakes; (xi) the inability to redeem or use any prize, including, without limitation, due to Force Majeure (defined below). TO THE MAXIMUM EXTENT PERMISSIBLE BY LAW, IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. WITHOUT LIMITING THE FOREGOING, THIS PROMOTION AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, AND SPONSOR HEREBY DISCLAIMS ANY SUCH WARRANTIES.
  14. DISQUALIFICATION/FORCE MAJEURE.  Sponsor reserves the right in its sole discretion to disqualify any individual who is found to have tampered with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in a disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to disparage, annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No incomplete, forged, software-generated or other automated multiple entries will be accepted. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.  In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from awarding the prize or continuing with the Promotion as contemplated herein by any event beyond his control, including but not limited to, event cancellation or modification, fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated due to Force Majeure relating to the Grand Prize, Sponsor will (if possible) conduct the drawing with all timely entries, awarding prizes other than the Grand Prize. Inclusion in such drawing shall be each Entrant’s sole and exclusive remedy under such circumstances. Only the type and quantity of prize described in these Official Rules (other than the Grand Prize) will be awarded in such event.
  15. DISPUTES. The provisions of these Official Rules are severable, and in the event any provision is determined to be invalid or unenforceable, the remaining provisions will remain in effect.  Except where prohibited by law, each Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) unless otherwise prohibited, under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the state, without giving effect to any choice of law or conflict of law rules (whether of the state of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Georgia.
